About these Terms

GoNative is a language-learning service operated by Oleksii Kudria, an individual (“we”, “us”). These Terms are an agreement between you and Oleksii Kudria. They apply to the GoNative web app, the iOS and Android apps, the browser extensions, and the free tools such as the Vocabulary test and Word Maker (together, “GoNative”).

By creating an account, signing in, or using GoNative, you agree to these Terms. If you do not agree, please do not use GoNative. How we handle personal data is described in our Privacy Policy.

Who can use GoNative

• You must be old enough under the law of your country to accept these Terms. GoNative is not intended for children below the age at which they may use online services without parental consent.
• If you are under the age of majority where you live, use GoNative with the permission of a parent or legal guardian, who accepts these Terms on your behalf.
• If you run a class or use GoNative on behalf of a school or another organization, you confirm that you are authorized to do so.

Your account

• You can sign up with an email address or a supported sign-in provider, such as Google or Apple. Keep your account details accurate and up to date.
• Keep your password safe. You are responsible for activity under your account; tell us promptly if you think someone else has access to it.
• A guest account works without an email address or password. Its progress may be lost if you sign out, clear your browser data, or reinstall the app before you create a full account.
• The Vocabulary test and the first level of Word Maker can be used without an account. Their results are kept for a limited time and move to your account when you sign up or sign in.
• You can delete your account at any time in the account settings. A deleted account cannot be restored. Deleting your account does not cancel a subscription purchased through the App Store or Google Play — cancel it in the store settings.

Free features and Premium+

• Many GoNative features are free. Some features and higher limits require a Premium+ subscription; the app marks them.
• Premium+ is sold as a subscription. The price, billing period, and any free trial are shown before you confirm the purchase.
• In the GoNative apps for iOS and Android, payments through the App Store or Google Play are processed by Apple or Google under their terms. A subscription bought there renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. You can manage or cancel it in your App Store or Google Play account settings.
• Refund requests for store purchases are handled by Apple or Google under their rules. This does not affect your rights under consumer protection law.
• Premium+ belongs to your GoNative account: sign in with the same account to use it in the apps and in the web version.
• With the family subscription, a Premium+ subscriber can share access with a limited number of people. Family members have Premium+ while the owner’s subscription is active and they stay in the family.
• We may change which features are part of Premium+ and what it costs. A price change does not apply to a period you have already paid for; the store applies it according to its rules.

Your content

Your content is everything you add to GoNative: words, lists, notes, texts, books, files, and images, as well as text you send from the browser extension.

• You keep all rights to your content.
• You allow us to store, process, and display your content only to run GoNative for you: for example, to translate it, build exercises and audio, sync it across your devices, and show it to the people you share it with.
• Add only content you have the right to use. Imported books and texts are for your own study; do not use GoNative to distribute other people’s works.
• When you share lists with family members or join a class, the other participants see what the feature shows them. For example, a teacher sees the lists assigned to the class and the students’ progress on them.
• We may remove content that breaks these Terms or the law.

Automatically generated content

Some GoNative content is created automatically, including with machine translation and artificial intelligence: translations, example sentences, explanations, exercises, images, audio, and podcasts. We work on its quality, but it may contain mistakes. Do not rely on it where accuracy is critical, such as for official, legal, or medical translations.

Acceptable use

When using GoNative, you may not:

• break the law or infringe the rights of others, including copyright;
• use GoNative for fraud or spam, including payment fraud;
• upload illegal, offensive, or harmful content or malicious code;
• harass or impersonate other people, including in the family subscription, classes, and shared lists;
• use bots, scrapers, or other automated means to access GoNative, or copy dictionaries, courses, images, audio, or other materials in bulk;
• bypass Premium+ restrictions, usage limits, or security measures, or try to access other users’ accounts or data;
• disrupt or overload GoNative, or decompile or reverse engineer it, except where the law expressly allows it;
• resell access to GoNative or use its materials to build a competing product.

GoNative materials

GoNative’s software, design, and learning materials, including dictionaries, courses, lessons, exercises, images, audio, and podcasts, belong to us or our licensors and are protected by intellectual property law. The GoNative name and logo may not be used without our permission.

We give you a personal, non-exclusive, non-transferable right to use GoNative and its materials for your own learning. Do not remove watermarks or other notices from images and materials, and do not republish them.

Third-party services

GoNative works with third-party services, such as Paddle, the App Store, Google Play, Google and Apple sign-in, and browser extension stores, and may link to other websites and podcast platforms. Their own terms and privacy policies apply to them, and we are not responsible for their content or availability.

Changes and availability

We keep developing GoNative and may add, change, or remove features, materials, and supported languages. We work to keep GoNative available, but it may be interrupted for maintenance, updates, or reasons beyond our control. If we decide to discontinue GoNative, we will try to let you know in advance.

Suspension and termination

You can stop using GoNative and delete your account at any time.

We may limit, suspend, or close an account that seriously or repeatedly breaks these Terms, is used for fraud or payment abuse, puts other users or GoNative at risk, or where the law requires it. When reasonable, we will tell you the reason and give you a chance to respond.

No guaranteed results

GoNative is a learning tool. We do not guarantee a particular result, exam score, or language level. Vocabulary test results and other estimates are approximate and are not an official certificate. To the extent permitted by law, GoNative is provided “as is” and “as available”.

Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits or missed opportunities, or for losses caused by mistakes in automatically generated content, third-party services, or events beyond our reasonable control. Our total liability for claims related to GoNative is limited to the amount you paid for Premium+ in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, such as for intentional misconduct or gross negligence, or your statutory rights as a consumer.

Governing law and disputes

These Terms are governed by the law of Portugal, without regard to its conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring a claim before its courts. Before going to court, please contact us: most issues can be resolved quickly.

Changes to these Terms

We may update these Terms when GoNative or the law changes. The current version is always on this page with the date of the last update. We will tell you about significant changes in the app or by email before they take effect. If you keep using GoNative after that, the updated Terms apply to you; if you do not agree, you can stop using GoNative and delete your account.

General

• If any part of these Terms is found invalid, the rest remains in effect.
• If we do not enforce a provision right away, we do not waive our right to enforce it later.
• These Terms and the Privacy Policy are the entire agreement between you and us about GoNative and replace earlier versions.
• If translations of these Terms differ, the English version prevails, unless the law of your country requires otherwise.
